Trump Asks Top Court Clearance for Military Reserve Personnel in Illinois

On the end of the week, the government filed an emergency request to the US supreme court, requesting authorization to send national guard forces to Illinois.

This step is part of a broader campaign to widen the internal deployment of the armed forces in a number of cities run by Democrats.

Judicial Challenge Over Military Presence

In an emergency filing, the US Department of Justice urged the court to overturn a previous judicial decision that had stopped the stationing of several hundred national guard members to the Chicago area.

The district judge had expressed skepticism about the government's justification for activating the guard, questioning its explanation in considering local conditions.

A appellate court affirmed the lower court’s decision on midweek, leaving the deployment on standby while the court case continues.

Government's Justifications

The solicitor general, representing the administration, stated in the new filing that government officers have often been “intimidated and attacked” in downtown Chicago and the outlying area of Broadview.

This site is home to an Immigration and Customs Enforcement holding center.

The former president has already sent national guard forces to Chicago, Illinois and Portland, following previous deployments to LA, the city of Memphis, and the nation's capital.

The White House has claimed that troop deployment is needed to curb unrest and support deportation efforts.

Political Resistance

Elected Democrats have vehemently criticized the move, saying that the president’s claims are greatly exaggerated and politically motivated.

They allege the former president of abusing his executive power to punish opponents.

Court officials have also raised questions about the White House's description of ongoing incidents.

Local leaders say that protests over deportation policies have been mostly small and non-violent, contradicting the president’s description of “war zone” situations.

Legal Basis

At the heart of the dispute is the government's invocation of a federal statute allowing the president to nationalize the military reserve only in cases of insurrection or when “unable with the federal troops to carry out the statutes of the US”.

The White House maintains that the personnel are required to defend US facilities and officers from activists.

Current Actions

In recent weeks, the administration federalized three hundred members of the Illinois military reserve and commanded additional guard from Texas troops into the state.

As city officials denounced the decision, the former president intensified his language, demanding the detention of Chicago’s mayor and the governor of Illinois, both Democrats, alleging them of failing to secure ICE personnel.

The state of Illinois and the city of Chicago together took legal action against the government to halt the activation.

On October 9, district Judge April Perry, a Biden appointee, delivered a preliminary order preventing the order.
